Andrew Victor

Andrew Victor has wide experience in government contracts with bid protests and claims, the federal False Claims Act, suspension and debarment, and internal investigations. His legal career has included positions as an associate at large law firms, a clerkship for a U.S. District Judge, and service as a Trial Attorney at the U.S. Department of Justice.

About

Andrew Victor focuses on representing government contractors in high-stakes commercial litigation, counseling, bid protests, contract claims, and white collar criminal investigations relating to fraud, waste, and abuse, and conflicts-of-interest. Andrew has represented a wide range of clients before the Court of Federal Claims and the Government Accountability Office (GAO).

Andrew has particular experience with the federal False Claims Act, suspension and debarment, and internal investigations. In his counseling practice, Andrew guides clients through the Federal Acquisition Regulation (FAR) System and the Defense FAR Supplement (DFARS).

 

Before joining Nichols Liu, Andrew worked as an associate at national law firms and clerked for a U.S. District Judge in the Eastern District of Michigan. Andrew began his legal career as a Trial Attorney in the Civil Division of the U.S. Department of Justice through the Attorney General’s Honors Program. Prior to law school, Andrew was also a Peace Corps Volunteer in Ukraine.

Experience

  • Represented contractor in successful bid protest before GAO raising an issue of first impression relating to an out-of-scope technical direction letter illegally modifying a GSA federal supply schedule contract for the provision of cloud computing services to the Navy.
  • Represented contractor in successful agency-level bid protest regarding the Army's inappropriate implementation of FAR pricing policy, resulting in cancellation of the Army's award, and re-opening the competition to include the contractor.
  • Represented multinational contractor in civil suit to obtain dismissal of complaint for lack of personal jurisdiction in a state where the company employed thousands of workers and headquartered one of its three primary business units.  The decision was one of the first to apply the personal jurisdiction test set forth by the Supreme Court in the Daimler and BNSF Railway cases.
  • Represented Mentor/Protege Joint Venture formed to provide asset management services to the U.S. Department of Housing and Urban Development in action before the Court of Federal Claims to obtain reversal of adverse size determination by the Small Business Administration's Office of Hearings and Appeals (SBA-OHA).
  • Represented contractors on appeals before the ASBCA arising from Contracting Officer Final Decisions on cost allowability treatment.
  • Assisted in several internal investigations relating to various government contracting issues, including alleged mischarging of labor and expenses, alleged misrepresentation of small business status, and potential violations of the Procurement Integrity Act and misappropriation of trade secret information.
